A few important terms.

1. Who we are

5DAYS is an independent creative and technology studio in the Netherlands. Where these terms say we, that is us. Where they say you, that is the person or company that books a sprint.

2. How a booking works

• You pick a sprint and a week on our booking page and send the request. That request is not yet an agreement.
• We reply in writing within one working day with the confirmed week, the scope and the price. The agreement starts when you accept that confirmation.
• A sprint is one working week, Monday to Friday, unless the confirmation says otherwise. We don't work on your project outside the booked week unless you book more.

3. Price and payment

Prices are fixed per sprint and stated in the confirmation. A reservation holds the week and is part of the total, not a fee on top of it. The remainder is due ten working days before the week starts. If it isn't paid by then, the week is released. See our refund policy and VAT and invoicing.

If your sprint includes a monthly agent, the monthly price, the term and the notice period are stated in the confirmation.

4. Moving or cancelling

You can move a week once, free of charge, more than ten working days in advance. Cancelling more than ten working days in advance is refunded minus ten percent. Inside ten working days the week is yours and can't be resold. The details are in our refund policy.

5. What we need from you

One hour on Monday, one person who can decide during the week, and access to your domain and the tools the site connects to. We start on Monday with what we have. Missing input doesn't extend the week.

6. Revisions and direction

On Tuesday you choose a direction. Revisions improve the direction you chose. A completely new direction reopens the design and is a new sprint, not a revision.

7. Ownership

On Friday everything is yours: the code, the content, the design files and every account the site runs on, in your name. Fonts and images are licensed to you where we can, and named where we can't. We may show the work publicly unless you tell us in writing not to.

8. Liability

We're liable up to the amount you paid for the sprint. We're not liable for lost profit, lost data, or anything caused by material you gave us that you didn't have the right to use. An agent prepares work for your approval unless you agree in writing that it may act on its own; what it does after that approval is your responsibility.

9. Law

Dutch law applies. Disputes go to the competent court in the Netherlands. Questions about these terms: hello@5days.io.
